General terms and conditions "Sailing School De Kaag", Hereinafter referred to as "De Kaag".
1. General
1.1 The General Terms and Conditions Watersport Academy "De Kaag" ("these terms and conditions") apply to all registrations, offers, quotations and agreements at, with or offered by Watersport Academy & Group Accommodation "De Kaag", Watersport Academy Spaarnwoude, hereinafter referred to as "De Kaag", and to participation in all facilities made available by "De Kaag". These conditions prevail at all times over any conditions applied by the client, unless otherwise agreed in writing.
1.2 "De Kaag" reserves the right to use photos and other images made during stays in and around our accommodation for promotional purposes such as our website and/or advertising brochures.
1.3 "De Kaag" does not guarantee that the information provided on its website(s) is free of errors and/or defects. If you have any doubts about the accuracy of the information or if you discover any errors, we recommend that you contact "De Kaag".
1.4 Trademarks & logos may not be reproduced without written permission from management.
2. Agreements
2.1 Requesting information; At the moment that you submit an information and/or quotation request to us, this is always without obligation. The possibility to take an option on the basis of an information and/or quotation request. This option is without obligation and valid for x number of days. "De Kaag" reserves the right to withdraw an offer in unforeseen circumstances. If in the meantime there is a request that makes your option no longer possible, we will inform you about this and you have 1 working day to decide whether you want to make the option final or to let it lapse. If we can't reach you by phone or mail we are unfortunately forced to cancel your option.
2.2 Registration for camps, sailing lessons, water skiing, Kids&Co or a reunion; When you register through the website, by email or by phone for these facilities, we consider this booking as final. You will then receive a confirmation/invoice within a few working days. Registrations will be processed in order of receipt. It may happen that a certain course in a certain period is already fully booked, we will then contact you to discuss possible alternatives. "De Kaag" reserves the right to cancel a booking in case of insufficient enthusiasm. Registration for our camp weeks, private lessons and day courses are subject to the HISWA conditions.
3. Guarantee and cancellation except camp weeks
3.1 When you register via the website, by e-mail or by telephone, the sailing lesson, waterski course, Kids&Co or reunion is definite. In the event of cancellation, you will owe the total course amount as a cancellation fee, regardless of the background. In consultation we can see if the dates can be moved, if this is not possible you will still owe the full course amount to "De Kaag". We recommend that you take out travel/cancellation insurance.
3.2 For Kids&Co, "De Kaag" reserves the right to run an alternative programme if the weather conditions do not allow the original programme to take place. 3.3 For Private Lessons and Day Courses, "De Kaag" will contact you as soon as possible if the weather conditions do not allow for the programme to take place. If there is no wind, if the constant wind is force 6 Bft or stronger or if there is a thunderstorm over the lakes, "De Kaag" will reschedule the lesson in consultation with you.
3.4 For all water ski lessons, private lessons and day courses, you can transfer them to another date in the same calendar year, free of charge, at least 9 days before the planned lesson date. In the event of cancellation you "De Kaag" owe the total amount of the course. We recommend that you take out travel/cancellation insurance.
3.5 Once you have confirmed an offer, cancellation fees up to 2 months prior to your booking are 50% of the invoice amount. After 2 months the costs are 100% of the invoice amount. If we cannot sail due to weather conditions and the event cannot be rescheduled, the cancellation fee is 50% of the invoice amount. We recommend that you contact your insurance adviser if you wish to take out cancellation insurance. "De Kaag" asks you to let us know the final number of persons at least 14 days before the start of the event due to planning and possible price changes. We apply a different margin in fewer participants of up to 10% (example; you book for 50 and arrive with 40 then you pay for 45).
3.6 The prices as mentioned remain valid during the offer duration á 30 days. When there is an agreement the prices are fixed. In the unlikely event that the booking has to be moved to a subsequent calendar year,De Kaagreserves the right to adjust the cost based on changes in cost prices.
4. Payment
4.1 For every booking you make with "De Kaag" you will receive a confirmation/invoice. "De Kaag" charges a deposit of 35% of the full and/or provisional invoice amount or equivalent, this deposit must be received by us within 14 days of receipt of the confirmation/invoice. When your booking is more than one year in the future we can extend the deposit period, the latest date of receipt of 35% of the invoice amount will be explicitly mentioned on the confirmation/invoice. When you do not make a down payment you cannot give any rights to the agreement with "De Kaag".
4.2 The remainder of the (provisional) invoice amount should be transferred no later than 14 days before the start of your booking. In consultation with the management this may exceptionally be adjusted.
4.3 Should there be an after-calculation due to additional persons or consumptions consumed you will receive a final invoice. This must be paid within 14 days of receipt.
5. Liability
5.1 Insurance; "De Kaag" has taken out third-party liability insurance. It should be noted that registration for both water sports activities and stays at our accommodation involves a certain assumption of risk by the customer (e.g. the loss of glasses on board a (sailing) boat is not insured). "De Kaag" is therefore in no way liable for damage to or loss of personal property. We strongly advise you not to bring electronic equipment.
6. Regulations
6.1 Participants must follow all written or verbal instructions as well as all instructions from personnel of "De Kaag" at all times.
6.2 Participants are not allowed to: - put others in danger - use the facilities offered in a way other than that for which they are intended, or use them in such a way that they cause or may cause danger to other participants.
7. Applicable law
7.1 All agreements and purchases are governed exclusively by Dutch law, even if all or part of an obligation is performed abroad or if the party involved in the legal relationship is domiciled there.
